Please read these Terms of Service carefully before using the GameDay Music app. By downloading, installing, or using GameDay Music, you agree to be bound by these terms. If you do not agree, do not use the app.
These Terms of Service ("Terms") are a legal agreement between you and GameDay Music LLC ("GameDay Music," "we," "us," or "our"), an Illinois limited liability company. These Terms govern your use of the GameDay Music iOS application and related services (collectively, the "Service").
You must be at least 13 years old to use GameDay Music. By using the Service, you represent that you are at least 13 years of age. The Service is intended for use by coaches and team administrators. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
To use GameDay Music, you must create an account using Apple Sign In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately at support@gamedaymusic.app if you become aware of any unauthorized use of your account.
Subscription Plans
Free Trial
New users receive a 14-day free trial with full access to all features. No credit card is required during the trial period. After the trial ends, a subscription is required to continue using the Service.
Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
Voice Credits
Voice credits are used to generate AI player introductions. Credits are available for separate purchase: 1 credit ($2.99), 15 credits ($24.99), or 50 credits ($49.99). Credits are non-refundable once used. Unused credits do not expire.
Refunds
All purchases are processed through the Apple App Store. Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.
Voice introductions are generated using ElevenLabs AI text-to-speech technology. Each voice credit generates one player introduction. Credits are consumed at the time of generation regardless of whether the output is used in a game. We do not guarantee any specific voice quality, accuracy, or availability of AI voice features, as these depend on third-party services.
GameDay Music integrates with Apple Music via MusicKit. An active Apple Music subscription is required to use streaming music features. Local audio files may be used as an alternative where available. GameDay Music is not affiliated with or endorsed by Apple Inc. in connection with music licensing.
You agree not to:
You retain ownership of all content you upload to GameDay Music, including team names, player names, logos, and audio files. By providing this content, you grant GameDay Music a limited license to store, process, and display it solely for the purpose of operating the Service for you.
You represent that you have all necessary rights to any content you upload, including any logos, images, or audio files. You are responsible for ensuring that your use of music through Apple Music complies with applicable licensing terms.
The GameDay Music app, including its design, code, and content (excluding user-provided content), is owned by GameDay Music LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written consent.
Your use of GameDay Music is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, GAMEDAY MUSIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless GameDay Music LLC and its members, officers, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time from within the app under Settings → Account → Delete Account.
These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Illinois.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
